1. Introduction

1.1 These General Terms of Service ("Terms") govern the provision of services by Atmosphere Mining Studio, a business registered at No. 543, Zhanglu Road, Heming Village, Xiushui Township, Changhua County, Taiwan (R.O.C.), with Uniform Invoice Number 88582781 and registered in the business registry of the Changhua County Government (the "Company", "we", "our", or "us").

These Terms apply to any individual, company, organization, or other entity accessing or using any services provided by Atmosphere Mining Studio (the "User" or "you").

1.2 Please read these Terms carefully. They set forth the rules governing your use of our services, describe your legal rights and obligations, and explain the rights you grant to us when you use our services.

1.3 Please also review our Privacy Policy and any other policies or documents referenced in these Terms. A list of Atmosphere Mining Studio's binding or reference documents may be accessed through the Website.

2. Atmosphere Mining Studio Services

2.1 Atmosphere Mining Studio provides services related to earthquake precursor detection, analysis, and related informational content, as well as other products, features, and services that may be developed or offered from time to time (collectively referred to as the "Services").

The Services include, but are not limited to:

• the Atmosphere Mining Studio Website
• Atmosphere Mining Studio mobile applications for iOS, Android, and other supported operating systems and devices (including smartwatches)
• the Atmosphere Mining Studio Community, which enables users to discuss and exchange information, techniques, and materials related to the Services
• the Atmosphere Mining Studio API
• the Atmosphere Mining Studio Earthquake Precursor Stations

Atmosphere Mining Studio Earthquake Precursor Stations may be accessed through the Website. Users may interact with these stations and related data via the web interface provided on the Website.

For more detailed descriptions of the Services and their functionalities, please visit the Website or the Atmosphere Mining Studio Community.

2.2 By registering for an account, accessing, or otherwise using any of our Services, or by accessing any data, visual materials, or other information provided through the Services (collectively referred to as the "Content"), you acknowledge that you have read, understood, and agreed to be bound by these Terms. Such acceptance constitutes a legally binding agreement between you and Atmosphere Mining Studio.

2.3 The agreement between you and Atmosphere Mining Studio includes:

• these General Terms of Service,
• any rights and obligations referenced within these Terms, and
• any additional terms or conditions that apply to specific Services, features, or functionalities (the "Additional Terms").

These Additional Terms may be made available through the Website or other appropriate channels. By using the applicable Services, you agree to comply with such Additional Terms.

Together, these documents constitute the "Agreement." In the event of any conflict between these General Terms and any applicable Additional Terms, the Additional Terms shall prevail with respect to the relevant Service or feature.

2.4 The current version of this Agreement, including any terms applicable to specific Services, is available on the Website.

2.5 By registering for or using the Services, you acknowledge that you have read and understood this Agreement, accept its terms, and agree to be bound by them. If you do not agree to, or are unable to comply with, this Agreement, you must not use the Services or access any Content provided through the Services.

2.6 In general, the Services of Atmosphere Mining Studio are available to both registered and non-registered users. However, certain additional features and functionalities are only available to users who have registered an account on the Atmosphere Mining Studio Website (the "Registered Users").

3. Free and Paid Services

3.1 Free and Paid Services

3.1.1 Information about our Services, including which Services or features are available exclusively to Registered Users, can be found on our Website. Most of our Services are provided free of charge. Services that do not require payment are referred to as "Free Services," while Services that require payment in order to access or use are referred to as "Paid Services."

3.1.2 Free Services are intended for personal use only. Any use by organizations, institutions, or other entities requires the use of the applicable Paid Services.

3.1.3 We reserve the right, at any time and in accordance with these Terms of Use, to modify, suspend, discontinue, or otherwise revise any Services, plans, or applicable fees.

3.2 Subscriptions, One-Time Purchases, and Price Changes

3.2.1 Paid Services may be purchased through third-party platforms in two forms:

• by paying a recurring subscription fee in advance for a billing period disclosed prior to purchase (a "Subscription"), or
• by making a one-time purchase.

If you purchase Paid Services through a third party, you acknowledge that such third party may impose additional terms and conditions in addition to this Agreement. Specific payment methods and billing periods may vary depending on the Paid Service.

If you purchase a Subscription, you authorize the applicable third party to charge the subscription fee on behalf of Atmosphere Mining Studio for each recurring billing period until you cancel the Subscription.

3.2.2 Atmosphere Mining Studio may modify the prices of Paid Services from time to time. For users who have already subscribed to a Paid Service, any price change will take effect at the beginning of the next subscription billing cycle following the effective date of the price change.

Your continued use of the relevant Paid Service after the price change becomes effective constitutes acceptance of the new price. If the price of a Subscription changes, Atmosphere Mining Studio will notify you in advance, either directly or through the third party from whom you purchased the Subscription, and where applicable provide instructions on how to accept the changes.

If you do not agree to the price change or fail to take the required action, your Subscription will expire at the end of the current billing cycle and will not automatically renew.

3.3 Trials

3.3.1 We may offer free trial periods for certain Paid Services for a specified duration (the "Trial"). To start a Trial, you may be required to provide payment information. By providing such information, you agree that we may automatically charge the applicable subscription fee beginning the day after the Trial period ends, based on the recurring or other billing cycle disclosed to you in advance.

If you do not wish to be charged, you must cancel the applicable Paid Subscription through the relevant third-party platform in accordance with that platform's terms of service before the Trial period ends.

3.3.2 We reserve the right to determine your eligibility for a Trial, and to withdraw, modify, or terminate any Trial at any time without prior notice and without liability.

3.4 Consumer Right of Withdrawal

3.4.1 The provisions of this Section 3.4 apply only to Users who qualify as consumers under applicable consumer protection laws, and who are granted a statutory right of withdrawal from the relevant Paid Service under such laws.

3.4.2 If you register for a Subscription or make a one-time purchase, you may change your mind for any reason, or for no reason at all, and cancel the relevant Paid Service within 14 days from the date of registration or purchase (the "Cancellation Period").

3.4.3 By registering for a Subscription or making a one-time purchase, you expressly request that we begin providing the relevant Paid Service immediately, including before the end of the applicable Cancellation Period.

3.4.4 You may cancel your Subscription or one-time purchase through the third-party platform through which you registered for the Subscription, in accordance with that platform's terms of service. If cancellation cannot be completed through the third party, you may contact us via email to request cancellation.

3.4.5 If you cancel a Subscription or one-time purchase within the Cancellation Period, we will refund any prepaid fees for the remaining portion of the relevant period, calculated from the effective date of cancellation.

3.5 Subscription Renewal and Cancellation

3.5.1 Paid Services purchased through third-party platforms will automatically renew unless you cancel the Subscription before the end of the current subscription period. If you purchased a Subscription through a third party, you may cancel it in accordance with that third party's terms of service. Such cancellation will take effect on the day following the end of the current subscription period.

3.5.2 If you cancel payment, the Paid Service, and/or terminate any applicable agreement before the end of the current subscription period, any fees already paid will not be refunded.

3.6 Maintenance of Paid Services

3.6.1 You acknowledge and agree that while we will make reasonable efforts, we are not obligated to maintain, support, upgrade, or update any Paid Services, nor to continue providing all or any specific Content through such Paid Services, except as required by applicable laws and regulations that cannot be contractually waived.

Atmosphere Mining Studio and its Suppliers (as defined in Section 4.2) reserve the right to remove any Content without prior notice, or to partially or completely discontinue any Paid Service at any time.

4. Use of Our Services

4.1 Legal Requirements

4.1.1 To use our Services, you must be at least 16 years old, or at least 13 years old but under 16 years old with the written consent of a parent or legal guardian, unless the laws of your country of residence require a higher minimum age, in which case you must meet that requirement.

4.1.2 You further represent and warrant that any registration information you provide to Atmosphere Mining Studio is true, accurate, and complete, and you agree to keep such information updated at all times.

4.2 License to Use

4.2.1 The Services and the Content are the property of Atmosphere Mining Studio or our licensors, suppliers, and other business partners (collectively referred to as the "Suppliers").

4.2.2 We grant you a limited, non-exclusive, and revocable license to access and use the Services and the Content (the "License"). This License shall remain in effect until it is terminated by either you or Atmosphere Mining Studio in accordance with this Agreement.

4.2.3 You agree that you will use the Services and the Content solely for your personal use, and that you will not redistribute, sublicense, transfer, or otherwise make available our Services or Content to any third party (this restriction does not apply to the use of Atmosphere Mining Studio embedded widgets where such use is permitted).

You may not use the Services or Content for internal organizational purposes, commercial purposes, or to create value-added services, except where such use is explicitly permitted by applicable Additional Terms. The restrictions set forth in this section do not apply where such use is expressly authorized under the relevant Additional Terms.

4.2.4 Our software applications and Content are licensed, not sold or transferred, to you. Atmosphere Mining Studio and our Suppliers retain ownership of all copies of our software applications and Content, even after they have been installed on your personal computer, mobile phone, tablet, or other device (collectively referred to as "Devices").

4.2.5 All Atmosphere Mining Studio trademarks, trade names, logos, domain names, and other brand features of Atmosphere Mining Studio or our Suppliers (collectively referred to as "Brand Features") are the exclusive property of Atmosphere Mining Studio or our Suppliers.

Nothing in this Agreement grants you the right to use any Brand Features. However, this does not prevent you from using the Atmosphere Mining Studio name or logo where required under this Agreement, including when referencing the Atmosphere Mining Studio Website.

4.2.6 You agree to comply with all rules set forth in this Agreement and not to use the Services, the Content, or any part thereof in any manner not expressly permitted by this Agreement. Except for the rights expressly granted to you in this Agreement, no other rights, title, or interest in or to the Services or Content are granted to you.

4.3 Third-Party Applications and Devices

4.3.1 In order to provide our Services, the Services may integrate with or otherwise interact with third-party applications, websites, services (collectively, "Third-Party Applications"), and third-party devices.

These Third-Party Applications and devices may have their own terms of use and privacy policies, and your use of them will be governed by those terms. You acknowledge and agree that Atmosphere Mining Studio does not endorse and is not responsible for the functionality, features, or content of any Third-Party Applications or devices, and does not guarantee that such applications or devices will remain compatible with our Services.

4.4 Further Development

4.4.1 The provision of the Services does not include any obligation on the part of Atmosphere Mining Studio to further develop existing Service features or components, nor to develop any new Service features or components.

4.4.2 In order to ensure the operability, security, and continued improvement of the Services, we may modify the Services from time to time. Such modifications may include improving existing features or functionalities, adding new features or functionalities, implementing advances in the scientific or technological methods used in the Services, and making reasonable technical adjustments.

4.5 Technical or User Support

4.5.1 Free Services do not include any technical or user support.

4.5.2 Paid Services include technical and user support provided via email during business hours, defined as 09:00 to 17:00 (GMT+8) on working days.

4.6 Prohibited Activities

4.6.1 The following activities shall be considered misuse of the Services and a material breach of this Agreement, and may result in the suspension or termination of your access to the Services:

• continuously scanning large amounts of Content and/or downloading large volumes of Content;
• scraping the Services, or otherwise automatically viewing, accessing, or collecting information from the Services by automated means;
• reverse engineering, copying, decompiling, disassembling, or otherwise attempting to determine the composition, structure, or underlying characteristics of the Services or any part thereof;
• selling, renting, sublicensing, leasing, or otherwise commercially exploiting any part of the Services or Content;
• circumventing or blocking advertisements displayed within the Services;
• using mechanisms, software, or other methods that interfere with or disrupt the Services, or taking actions that may overload, damage, or impair the Website, the Services, or our infrastructure;
• tampering with, disrupting, or attempting to detect, scan, or test vulnerabilities in the Services, our computer systems, networks, usage rules, security components, authentication mechanisms, or other protection measures applicable to the Services or Content;
• providing your Service login credentials to any other person, or using another person's username and password; and
• engaging in any activity that conflicts with this Agreement, as determined by Atmosphere Mining Studio.

4.7 Service Availability and Discontinuation

4.7.1 We reserve the right, at any time and without prior notice, explanation, or liability to you, to take any of the following actions for any reason we consider appropriate:

• modify, supplement, or restrict the Services, the scope of their features or functionalities, or the Content;
• change or upgrade the software versions used in the Services;
• terminate the operation of a specific version of the Services or any of its functionalities;
• partially or completely discontinue the Services; or
• convert Free Services into Paid Services.

4.8 Usage Restrictions

4.8.1 We also reserve the right, at our sole discretion, to immediately restrict or completely prohibit your use of the Services, including by disabling the account of a Registered User or by other means, particularly in the following cases:

• if you violate this Agreement or applicable laws;
• if we are legally required to do so; or
• if we are required to do so by a governmental authority.

5. Responsibility for Content

5.1 Limited Liability for Content

5.1.1 The purpose of this research experiment is to evaluate the reliability of earthquake precursor signals and to collect large amounts of data from various regions worldwide regarding precursor signals and the corresponding actual earthquake magnitude, distance, and timing, in order to improve the accuracy of future predictions when similar precursor signals occur in the same regions.

You acknowledge that the research data is generated based on satellite data and high-altitude atmospheric flow precursor detection techniques. The data is not continuously monitored 24 hours a day, and anomalies may not always be captured in real time. Therefore, the data and results may contain a certain margin of error.

5.1.2 Accordingly, Atmosphere Mining Studio has limited control over the Content provided through the Services. We assume no responsibility for any Content displayed or otherwise made available through our Services, particularly with respect to its correctness, accuracy, or completeness, regardless of the platform or service through which such Content is displayed, accessed, or used.

To the fullest extent permitted by applicable law, Atmosphere Mining Studio shall not be liable to you (as a user of the Services) or to any third party for any reliance on or use of such Content.

6. User Content

6.1 User Content

6.1.1 Because earthquake prediction is a socially sensitive matter, users of the Services are not permitted to publish, upload, or otherwise contribute content to the Services, including but not limited to text, messages, information, images, or any other type of content (collectively referred to as "User Content").

For the avoidance of doubt, User Content includes any content posted in the Atmosphere Mining Studio Community or in any other part of the Services.

6.2 Responsibility for User Content

6.2.1 You are solely responsible for all User Content that you contribute to the Services. Atmosphere Mining Studio assumes no responsibility for any User Content and does not endorse any information contained in such User Content.

6.2.2 You agree to comply with all applicable legal requirements relating to any User Content that you provide through the Services. In this regard, you represent and warrant that you own or otherwise have the right to provide such User Content to the Services.

6.3 Prohibited Content

6.3.1 You must not publish or contribute any User Content to the Services that:

• is offensive, abusive, defamatory, pornographic, threatening, or obscene;
• constitutes illegal conduct or is intended to promote or facilitate any unlawful activity, including infringement of the intellectual property rights, privacy rights, or property rights of Atmosphere Mining Studio or any third party;
• contains malware, trojan horses, viruses, or other malicious code, or otherwise interferes with any user's ability to access or use the Services;
• contains links to, references to, or otherwise promotes commercial products or services without the express authorization of Atmosphere Mining Studio; or
• otherwise conflicts with this Agreement, as determined by Atmosphere Mining Studio.

6.4 Removal of User Content

6.4.1 Atmosphere Mining Studio may, but is not obligated to, monitor, review, or edit User Content. In any case, Atmosphere Mining Studio reserves the right, for any reason and at its sole discretion, to remove or disable access to any User Content, including User Content that Atmosphere Mining Studio determines violates this Agreement.

Atmosphere Mining Studio may take such actions without prior notice to you or to any third party. The decision to remove or disable access to User Content shall be made at our sole discretion, and we do not undertake any obligation to remove or disable access to any particular User Content.

6.5 Use and License of User Content

6.5.1 By contributing User Content to the Services, and in consideration of the rights granted to you under this Agreement, you agree that Atmosphere Mining Studio may use such User Content, and that such User Content may also be used by other users or third parties.

In this regard, you grant Atmosphere Mining Studio a worldwide, non-exclusive, royalty-free license to use your User Content in any manner and for any purpose, including but not limited to:

• displaying, downloading, storing, and processing the User Content;
• analyzing the User Content and incorporating the results of such analysis into the Services;
• forwarding or integrating the User Content into any of our Services, whether commercial or non-commercial;
• using the User Content for marketing, sales, or other commercial purposes of Atmosphere Mining Studio;
• publishing, translating, modifying, creating derivative works from, and distributing the User Content through any media or communication channels, where applicable.

6.5.2 Feedback. If you provide Atmosphere Mining Studio with any feedback, ideas, or suggestions regarding the Services (the "Feedback"), you acknowledge that such Feedback is non-confidential and grant Atmosphere Mining Studio the unrestricted right to use such Feedback without any obligation to compensate you. For the avoidance of doubt, Feedback constitutes a form of User Content.

6.5.3 License to User Content. User Content is protected by applicable intellectual property laws. By submitting User Content to the Services, you hereby grant Atmosphere Mining Studio a non-exclusive license to use your User Content in any manner (the "License").

The License granted to Atmosphere Mining Studio is:

• worldwide,
• unlimited in territory and quantity,
• valid for the entire duration of the applicable copyright protection period, and
• granted free of charge.

Atmosphere Mining Studio is under no obligation to use such License.

Atmosphere Mining Studio may grant sublicenses or assign the License, in whole or in part, to third parties without restriction, whether for consideration or otherwise. Accordingly, third parties may also use the User Content in the manner permitted under this Agreement.

This License shall remain in effect after termination of your use of the Services. Deletion of User Content by you shall not affect this License, and Atmosphere Mining Studio and authorized third parties may continue to use the User Content in accordance with this License. However, Atmosphere Mining Studio may anonymize such content where appropriate.

7. Advertising Through Atmosphere Mining Studio Services

7.1 In consideration of the rights granted to you under this Agreement, you authorize us to provide you with advertisements and other information, and to allow our business partners to do the same. The Services and Content you access may contain advertisements.

8. Use of Visual Materials of the Services and Content by Users and Media Publishers

8.1 Scope

This Section sets forth the terms governing the use by users and third parties (whether individuals or media publishers) of any visual materials in films, television programs, documentaries, websites, blog posts, projects, or any other media or intellectual property works, whether for commercial or non-commercial purposes (collectively, "Media"), including the further distribution, sale, licensing, marketing, advertising, or promotion thereof (collectively, "Permitted Uses").

For the purposes of this Section, any third party intending to use or using such visual materials shall be deemed a User.

8.2 Visual Content Use License

Subject to the terms of this Agreement, we hereby grant you a license to use the visual content for Permitted Uses (the "Visual Content Use License"). This Visual Content Use License is worldwide, non-exclusive, and royalty-free.

8.3 Modification and Revocation

We reserve the right, at any time and without compensation, to:

• revoke the Visual Content Use License granted to you,
• modify the terms governing the use of visual materials,
• provide visual materials under separate terms, or
• discontinue the distribution of visual materials.

If we revoke the Visual Content Use License or modify or terminate its terms, such revocation, modification, or termination shall not affect any license rights already granted to you prior to such change, provided that:

• you have already integrated the visual materials into your Media, and
• you cannot reasonably be required to remove such visual materials from the Media (for example, visual materials integrated into television programs or other completed audiovisual works).

8.4 General Conditions of Use

8.4.1 The exercise of the Visual Content Use License is subject to the following conditions:

• Attribution. You must ensure that all visual materials used in your Media include appropriate source attribution (preferably the Atmosphere Mining Studio logo), or, in cases where size constraints apply (e.g., cropped images), the following credit line: "Source: Atmosphere Mining Studio". Where reasonably possible (for example, when used on a website), you should include a hyperlink to the Atmosphere Mining Studio Website.
• Reasonable Use. You may use the visual materials in your Media provided that such use is reasonable and does not harm our interests in developing and promoting the Services.
• No Unauthorized Modification. Except for modifications enabled by Atmosphere Mining Studio features, you may not alter the visual materials in any way. Minor technical adjustments necessary for Media usage (e.g., resizing or scaling) are permitted, provided that the original appearance is not substantially changed.

8.5 Restrictions on Certain Service Components

The visual elements of certain Service components may be subject to additional restrictions. Where applicable, such restrictions shall apply in addition to the terms set forth in this Agreement.

8.6 Special Rules Regarding Specific Features and Formats

For the purposes of this Agreement, the term "Visual Materials" shall also include any text, data, software code, and other features or formats referenced below.

8.6.1 Screenshots, Videos, and GIF Animations. Screenshots, videos, and GIF animations may be used for both personal and commercial purposes. However, the original visual appearance must not be substantially modified.

8.6.2 KML, GPX, or GeoJSON Uploads. Data uploaded by users to the Services in KML, GPX, or GeoJSON formats may not be used for personal or commercial purposes outside the Services. Users may add their own information (e.g., supplementary descriptions), provided that the original visual presentation is not significantly altered.

8.6.3 Atmosphere Mining Studio Articles. If articles are used for screenshots or other forms of display, the article and its author must be properly credited, and the applicable licensing terms (typically Creative Commons licenses) must be respected. Atmosphere Mining Studio assumes no responsibility for the content of such articles.

8.6.4 Atmosphere Mining Studio Plugins. In order to integrate a plugin with our Services, the plugin must be open-source, and Atmosphere Mining Studio must be permitted to modify it. Plugins must not enable unauthorized data extraction, scraping, or misuse of our data. As plugins are created by third parties, you acknowledge that Atmosphere Mining Studio cannot guarantee their proper functioning, nor that they are free from computer viruses, malware, or third-party advertisements. Atmosphere Mining Studio assumes no liability whatsoever for plugins or their use.

8.7 Special Rules for Use of Visual Materials in Marketing

When users or third parties use the above-mentioned Media types for marketing or promotional purposes, the following additional rules apply:

8.7.1 Printed Publications. Visual materials may be used only in printed publications (including books, journals, non-periodical print materials, presentations, or other private documents), provided that the total print run does not exceed 5,000 copies. This restriction does not apply to travel guides, manuals, or atlases where visual materials constitute the primary content. Such use is prohibited unless a separate prior written agreement has been concluded with Atmosphere Mining Studio.

8.7.2 Promotional Materials, Advertisements, Consumer Products, Television, Film, and Video. Except where a separate prior agreement has been concluded with Atmosphere Mining Studio, visual materials may not be used in:

• promotional materials,
• commercial advertisements, or
• consumer products (e.g., T-shirts, mugs, posters, office supplies, printed advertisements),
• television productions, films, or video recordings.

9. Disclaimer

9.1 The information provided through the Services is intended for members' reference only and must not be publicly disclosed. Any public disclosure shall be at your own legal risk and responsibility.

9.2 This research is conducted for the purpose of testing the reliability of earthquake precursor signals. The Platform does not guarantee the completeness, timeliness, or accuracy of the data. Any warranties implied by law or otherwise are hereby excluded to the maximum extent permitted by applicable law.

9.3 We do not guarantee the functionality, availability, or quality of the Services, nor do we assume any responsibility for the accuracy, completeness, or quality of any information provided through the Services and Content. We are not responsible for ensuring that the information provided through the Services is up to date.

9.4 Furthermore, Atmosphere Mining Studio makes no representations and provides no warranties, endorsements, or guarantees, and assumes no liability with respect to any third-party applications (or their content), User Content, devices, or any products or services advertised, promoted, or offered by third parties through the Services, on any linked websites, or in any banners or other advertisements.

9.5 Any advice or information obtained from Atmosphere Mining Studio, whether oral or written, shall not constitute any warranty of any kind.

10. Limitation of Liability

10.1 Under no circumstances shall Atmosphere Mining Studio be liable to you or any third party for any loss, cost, or damage (including loss of profits, whether monetary or non-monetary) arising from:

• any use of the Services or Content in any manner;
• the operation of the Services and Content, including administrative and technical activities related thereto;
• the functionality or availability of the Services; or
• any other matters related to the Services, Content, or this Agreement.

10.2 You agree that Atmosphere Mining Studio shall have no obligation or liability for any third-party applications or their content accessed through or in connection with the Services.

10.3 You agree that your sole and exclusive remedy for any issue or dissatisfaction with the Services is to uninstall any Atmosphere Mining Studio software and cease using the Services.

10.4 In all other cases, any liability of Atmosphere Mining Studio toward you or any third party shall be limited to the maximum extent permitted by applicable law.

10.5 The provisions of this Section apply to the fullest extent permitted by law.

11. Indemnification

11.1 You agree to indemnify, defend, and hold harmless Atmosphere Mining Studio from and against any and all damages, losses, and expenses (including reasonable attorneys' fees and litigation costs) arising out of or related to:

• (i) your breach of this Agreement;
• (ii) any User Content you post or otherwise provide to the Services;
• (iii) any activities conducted by you on or through the Services; and
• (iv) your violation of any applicable law or the rights of any third party.

12. Data Protection

12.1 Atmosphere Mining Studio strictly complies with applicable data protection laws and is committed to the proper handling of all personal data.

Atmosphere Mining Studio is a company established under the laws of the Republic of China (Taiwan) and is therefore primarily subject to the Personal Data Protection Act of the Republic of China (Taiwan).

In principle, any recorded personal data is used solely for the purpose of providing the requested Services. Atmosphere Mining Studio is committed to implementing appropriate technical and organizational measures to protect all recorded personal data against unauthorized processing.

In the event of misuse or suspected criminal activity, Atmosphere Mining Studio reserves the right to review the relevant data and, upon lawful request, provide such data to the competent authorities.

13. Term and Termination

13.1 This Agreement shall remain in effect until terminated by either you or Atmosphere Mining Studio. However, you acknowledge and agree that the license granted by you with respect to User Content is irrevocable, and shall continue in effect even after this Agreement expires or is terminated for any reason.

13.2 Atmosphere Mining Studio may terminate this Agreement or suspend your license to use the Services at any time, including in cases of actual or suspected unauthorized use of the Services and/or Content, failure to comply with this Agreement, or withdrawal of the Services and/or Content.

13.3 If this Agreement is terminated by either party, or if Atmosphere Mining Studio suspends your license to use the Services, you agree that Atmosphere Mining Studio shall have no liability to you, and, to the maximum extent permitted by applicable law, shall not be required to refund any amounts already paid.

13.4 You may terminate this Agreement at any time by ceasing use of the Services. If you are a Registered User, you may terminate this Agreement by deleting your user account through the Website.

13.5 The following provisions shall survive termination of this Agreement: Sections 5 (Content Responsibility), 6 (User Content), 9 (Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), 13 (Term and Termination), 15 (Final Provisions), and any other provisions which by their nature or express terms are intended to survive termination.

14.1 If you have any questions regarding the Services or this Agreement, you may contact us via email.

14.2 You agree that we may send you notifications and information related to your use of the Services and your user account in electronic form, including but not limited to payment authorizations, invoices, password changes, and confirmation messages, for example via the email address you provided during registration.

15. Final Provisions

15.1 Entire Agreement

15.1.1 Unless otherwise provided herein or expressly agreed in writing between you and Atmosphere Mining Studio, this Agreement constitutes the entire agreement between you and Atmosphere Mining Studio regarding the subject matter hereof and supersedes any prior agreements relating to such subject matter.

15.1.2 This shall not affect any separate agreements that may be concluded between you and Atmosphere Mining Studio regarding specific Services.

15.2 Severability

15.2.1 Unless otherwise stated in this Agreement, if any provision of this Agreement is held to be invalid or unenforceable for any reason or to any extent, such invalidity or unenforceability shall not affect the remaining provisions, which shall remain in full force and effect to the maximum extent permitted by law.

Where possible, any invalid provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent.

15.3 No Waiver

15.3.1 Failure by Atmosphere Mining Studio to enforce any provision of this Agreement shall not constitute a waiver of its right to enforce such provision at any time thereafter.

15.4 Interpretation

15.4.1 In this Agreement, the terms "including" and "includes," and variations thereof, shall be interpreted as meaning "including, without limitation."

15.5 Assignment

15.5.1 Atmosphere Mining Studio may assign this Agreement, in whole or in part, and may transfer any of its rights and obligations hereunder.

You may not assign, transfer, or sublicense this Agreement, in whole or in part, to any third party without prior written consent from Atmosphere Mining Studio.

15.6 Third-Party Rights

15.6.1 Unless otherwise specified, this Agreement is not intended to grant any rights to any person other than you and Atmosphere Mining Studio, and in no circumstances shall this Agreement create any third-party beneficiary rights. Furthermore, the right to terminate, revoke, amend, waive, or settle this Agreement does not require the consent of any other person.

15.7 Conflict with Consumer Protection Law and Other Mandatory Laws

15.7.1 Nothing in this Agreement shall affect your statutory rights as a consumer or any other mandatory laws applicable to this Agreement, to the extent that such rights and laws cannot be limited or waived by agreement between the parties.

15.8 Governing Law and Dispute Resolution

15.8.1 This Agreement (as well as any non-contractual disputes or claims arising out of or in connection with it) shall be governed by the laws of the Republic of China (Taiwan), without regard to conflict of law principles.

15.8.2 You and Atmosphere Mining Studio agree that the courts of the Republic of China (Taiwan) with competent geographical jurisdiction shall have exclusive jurisdiction over any disputes, claims, or controversies arising from this Agreement (including any non-contractual disputes or claims arising out of or in connection with it), and such matters shall be adjudicated in accordance with the laws of the Republic of China (Taiwan).

15.9 Sales Demonstration

15.9.1 The User agrees that Atmosphere Mining Studio may refer to the User as a "customer" on its website, in sales presentations, and in new user outreach activities by mentioning the User's company name and/or logo. Such consent shall remain valid during the term of this Agreement and for five years following its termination or expiration.

15.10 Amendments to the Agreement and Service Termination

15.10.1 Atmosphere Mining Studio reserves the right to reasonably modify the services in response to market developments, operational needs, organizational changes, or business process adjustments, in order to provide complex and competitive services. Accordingly, we also reserve the right to reasonably amend these Terms of Use or any additional terms, particularly in the event of changes in applicable laws or regulations, technological changes, or operational, organizational, or business process changes and/or changes to the services described above. Such amendments shall become effective upon publication on the website. Atmosphere Mining Studio will notify users of changes in an appropriate manner depending on the nature of the relevant service; however, users are responsible for regularly reviewing these Terms of Use and any applicable additional terms. Continued use of the services after changes are published constitutes acceptance of such changes. If you do not wish to continue using the services under the revised Agreement, you may contact us to terminate your account or delete your account directly through the Atmosphere Mining Studio website.

15.10.2 In the event of material changes to subscription terms, we will provide users with sufficient advance notice to allow them to review the revised Agreement and terminate their subscription before the changes take effect, if they do not agree to the revised terms. If you obtained paid services through a third party, you must cancel the relevant paid services through that third party.

15.10.3 We reserve the right to terminate the services or any part thereof at any time without prior notice and without any obligation to provide compensation to users.

15.11 Effective Date

These Terms of Use shall take effect on May 1, 2026.
